VIII. THE FUTURE OF THE UNITED NATIONS
Since its creation in 1945, the UN has done much to promote international cooperation in economic and social goals, and to a lesser extent, world peace. The end of the Cold War and new possibilities for cooperation among the world’s major powers has given the UN an opportunity to realize the original vision of its founders. The UN now has a chance to become an international organization that can effectively maintain world peace within the limits of a system where individual nations maintain their own authority and independence.
Constantly challenged, the UN remains the only forum where all the nations of the world can gather to discuss pressing issues of peace and security. The UN’s greatest asset remains its ability to speak as the world’s voice, offering legitimacy and guidance on the paths nations follow to solve their problems. Despite the challenges it faces, the UN will likely play an increasingly central role in international politics in the coming decades.

Violence in
land conflicts became a common occurrence in 1991. A February report by the New
York-based human rights group Americas Watch asserted that police had burned
squatters' homes, beaten peasants, and stolen their property. The government's
response to the report claimed that in order to encourage foreign and domestic
investment in agriculture (the nation's most important economic sector),
property rights would have to be respected. Critics argued that the endemic
violence in the countryside was evidence that the change in government had not
changed the traditional forcible tactics of rural control. A private study
released in December 1990 reported that 78 percent of

The Great Compromise sparked a heated and no less contentious dispute over slavery. Even though the words slave and slavery do not appear in the Constitution, the convention included ten provisions dealing with slavery. The most serious dispute arose over how to assign House seats to Southern states. If seats in the House of Representatives were apportioned according to state populations that included slaves, Southern states would gain an advantage because of their large slave populations. Northern states pushed to exclude slaves from the population calculations altogether. Southern states resisted, threatening to scuttle the entire Constitution. Finally abolitionists from northern states compromised. They agreed to the infamous clause in Article I that counted slaves as only three-fifths of a person and that barred Congress from ending the slave trade before 1808. The settlement over slavery led the convention to accept the Great Compromise.
Instrumental
in convincing Republicans that it was futile to seek a compromise with the
president were his vetoes in early 1866 of two measures that won overwhelming
Republican support and were eventually enacted over his vetoes. The first of
these was the Freedmen's Bureau Bill, which continued the agency's operations
for another year. The second was the Civil Rights Bill, which extended
citizenship to blacks by defining all persons born in the

According to Article 1, Section 7, of the U.S. Constitution, the president has only limited veto authority since negation of a legislative act can be overridden by a two-thirds majority in both houses of Congress. A presidential veto, unlike that in many states, is comprehensive, applying to all parts of a bill, and the president must communicate to Congress the reasons for a veto. In 1996 Congress passed the Line-Item Veto Act, which gave the president the power to veto individual items in funding or tax bills. In one of the most controversial decisions of the year, the Supreme Court, in Rust v. Sullivan, upheld regulations of the Department of Health and Human Services prohibiting employees of family planning clinics that receive federal aid from engaging in abortion counseling, abortion referrals, or activities advocating abortion. (Congress passed legislation that would have removed those prohibitions but was unable to override a presidential veto.) The Court held that the regulations did not violate free speech rights or the right of women to choose abortion or infringe on the doctor-patient relationship. Though former regulations had required information on all options, including abortion, the Court held that the new regulations were reasonable under the statute involved and that the government may value childbirth over abortion and had no obligation to foster activities it opposed even if such activities are constitutionally protected. This holding, if applied broadly to other areas where federal funding is important (such as the arts), was viewed by critics as providing government agencies with vast discretion over the content of expression.

Johnson Signs Civil Rights Bill
Lyndon Johnson's years of experience in Congress gave him an edge in pushing through his legislative proposals. Here Johnson signs the 1964 Civil Rights Act, which banned racial discrimination in public accommodations and by employers, unions, and voting registrars. The passage of the act over the objections of Southern senators was one of Johnson's greatest achievements.
Legislative veto.
Of all the opinions issued by the Court, none had greater impact than the one in the so-called 'one-house veto' case. In Immigration and Naturalization Service v. Chadha, the Court ruled unconstitutional, by a 7-2 vote, a provision of the Immigration and Nationality Act that, in effect, authorized one house of Congress to veto a decision of the executive branch. Five justices joined Chief Justice Warren E. Burger's majority opinion, which said that, given the bicameral structure of the legislative branch, the only permissible way for Congress to override an executive decision was by introduction of legislation to be passed by a majority of both houses and eventually signed by the president.

A close second in significance to the Chadha case was Arizona Governing Committee for Tax Deferred Annuity and Deferred Compensation Plans v. Norris, in which the Court ruled that the long-established policy whereby employers pay retired women smaller monthly benefits than retired men was a violation of the 1964 Civil Rights Act. Five members of the Court agreed that the practice, even though based upon statistics which accurately show that women as a class live longer than men as a class, constituted sex discrimination because the Civil Rights Act requires employers to treat their employees as individuals, not as members of a group. One of the five, Justice Sandra Day O'Connor, switched to the dissenters' view of the appropriate remedy, however, thus making the majority's holding applicable to future retirees only, not retroactive. Justice O'Connor was concerned that if employers were required to disburse greater annuity benefits than collected contributions could support, entire pension funds would be jeopardized.

the Norris case was Equal Employment Opportunity Commission v. Wyoming, in
which a 5-4 majority held, in an opinion written by Justice William J. Brennan,
Jr., that the federal age discrimination act (which generally prohibits
involuntary retirement before age 70) could be applied to state and local
governments as employers, without violating the Tenth Amendment's reservation
of states' rights. Justice Brennan drew a distinction between National League
of Cities v. Usery, a 1976 case in which the Court invoked the Tenth Amendment
to protect states against federal regulatory power, and Wyoming on the grounds
that the Wyoming case, concerning the involuntary retirement at age 55 of a
state game warden, would not cause nearly the same infringement of state
operational autonomy as the attempt in National League of Cities to apply
federal wage and hour provisions to state and local government workers. The

Because it takes a two-thirds vote of both the House and the Senate to override a presidential veto, Congress often modifies pending legislation to suit the president's preferences.
